NSW psychosocial code duty and inspections

Takes effect November 2026 to April 2027By WorkblissUpdated October 19, 2026

What’s happening

NSW employers must now follow the state's psychosocial hazards Code of Practice or show an equal or better approach (section 26A of the NSW WHS Act). SafeWork NSW has added inspectors who focus on psychosocial risk, can act before anyone is injured, and run a mandatory psychosocial check at workplaces with 200 or more workers.

What to do

Audit workload, job design, bullying and harassment controls against the NSW code and keep written evidence of consultation and controls ready for an inspector.
