Ban on non-compete clauses for most workers

Takes effect January 2027 to October 2027By WorkblissUpdated October 19, 2026

What’s happening

The draft Competition and Fair Work Legislation Amendment (Banning Unfair Non-Competes) Bill 2026 would ban non-competes for employees earning at or below the A$190,100 high income threshold, and co-worker non-solicitation clauses for all employees. It would also treat no-poach and wage-fixing deals between businesses as cartel conduct. Consultation closed October 2, 2026, and a 6-month transition would apply.

What to do

Review employment contract templates and restraint clauses now, and avoid unnecessary contract variations during the transition period.
