NSW's tougher psychological injury threshold excludes most serious claimants

Date October 12, 2026By WorkblissUpdated October 19, 2026

What’s happening

Data from Law Partners Injury Lawyers shows that only 88 of 1,514 NSW psychological injury claimants assessed at 15% impairment or more in 2024–25 would reach the new 25% threshold. That means more workers with serious mental injuries will lose long-term workers' compensation support.

What to do

Strengthen early intervention, return-to-work and employer-funded psychological support, since fewer serious cases will be covered by the scheme.
