Privacy policies must disclose AI and automated decisions

Takes effect December 10, 2026By WorkblissUpdated October 19, 2026

What’s happening

From December 10, 2026, organizations covered by the Privacy Act must explain in their privacy policies when they use computer programs, including AI tools, to make or substantially help make decisions that significantly affect people. Employment is one of the interests listed. The OAIC published final guidance on September 30, 2026.

What to do

List the AI and automated tools used in recruiting, rostering and performance decisions, update your privacy policy, and ask counsel how the employee records exemption applies to current staff (job applicants are not covered by it).
