Paternity leave doubles to 10 days

Takes effect January 1, 2027By WorkblissUpdated October 19, 2026

What’s happening

Law 15,371/2026 raises paternity leave from 5 to 10 days on January 1, 2027, then to 15 days in 2028 and 20 days in 2029 (the last step depends on a fiscal target), with the same rights for adoption. Employers pay the new paternity benefit (salário-paternidade) and are reimbursed by Social Security, Empresa Cidadã companies can add 15 more days, and dismissal without cause is barred from the start of leave until one month after it ends.

What to do

Update leave policies, payroll codes and manager guidance for births and adoptions from January 1, and consider pairing the longer leave with new-parent support.
