California limits AI workplace surveillance and requires AI disclosure in layoff notices

Takes effect January 1, 2027By WorkblissUpdated October 19, 2026

What’s happening

AB 1883 bars workplace surveillance tools that use facial, gait or emotion recognition or collect neural data. AB 1331 bans surveillance in workplace bathrooms, and SB 951 requires Cal-WARN notices to say when a mass layoff is substantially caused by AI or automation.

What to do

Audit monitoring, productivity and wellbeing tools used in California, including emotion-sensing or wearable features, and update layoff notice templates.
