California privacy rules on AI in employment decisions: compliance deadline
What’s happening
Businesses covered by the CCPA that already use automated decisionmaking technology (ADMT) for significant decisions such as hiring, promotion, pay or discipline must give pre-use notices, offer an opt-out (narrow exceptions apply), answer access requests and complete risk assessments. Tools adopted after this date must comply before use.
What to do
List every AI or algorithmic tool used on California applicants and employees, and put notices, opt-out processes and risk assessments in place before January 1.
