About this session

Negotiation creates situations in which people have different interests, incomplete information, competing incentives, and legitimate reasons to advocate strongly for their own position.

Ethical difficulty often appears in the gray areas: how much information should be disclosed, whether a statement is technically true but deliberately misleading, when pressure becomes coercive, how confidential information should be handled, or whether short-term advantage is worth damaging future trust.

Participants learn to approach negotiation through both outcome quality and process integrity.

They distinguish positions from interests, clarify their own ethical boundaries before pressure rises, assess the legitimacy of tactics, and recognize how credibility is built through consistency between words, commitments, and behavior.

The session also treats trust as a practical negotiation asset rather than a soft extra.

Participants explore how transparent process, realistic commitments, procedural fairness, verification, clear documentation, and effective repair can reduce friction and improve the durability of agreements while still allowing firm advocacy and commercial judgment.

What’s covered

Build the Ethical Foundation Before Negotiating

Every length
  • Clarify your non-negotiable boundariesEthical judgment becomes harder when pressure, targets, competition, or senior expectations increase.
  • Separate positions from legitimate interestsA stated demand is not always the underlying need.
  • Map stakeholders & consequencesAn agreement can benefit the people at the table while creating consequences for customers, employees, suppliers, communities, or colleagues who are not represented.
  • Prepare for the ethical pressure pointsMany ethical problems can be anticipated: confidential information, gifts, side agreements, misleading comparisons, personal relationships, conflicts of interest, aggressive targets, or requests to make commitments beyond someone's authority.

Use Information & Influence Responsibly

90 minutes and longer
  • Know the difference between privacy & deceptionNegotiators are not required to disclose every piece of information they possess, but withholding information is different from deliberately creating a false belief.
  • Communicate uncertainty honestlyForecasts, estimates, assumptions, and future commitments can easily sound more certain than the evidence justifies.
  • Influence without manipulationPersuasion can involve framing value, presenting evidence, establishing credibility, asking questions, and making consequences clear.
  • Protect confidential informationNegotiations may involve commercially sensitive, personal, proprietary, or privileged information that cannot simply be used because it would create leverage.

Navigate Power, Pressure & Difficult Tactics

3 hours and longer
  • Use power without exploiting itNegotiating power may come from alternatives, authority, information, scarcity, market position, resources, or the other party's dependence on the agreement.
  • Respond to questionable tacticsParticipants may encounter artificial deadlines, misleading anchors, intimidation, last-minute changes, deliberate ambiguity, personal pressure, or claims that appear unreliable.
  • Address conflicts of interestPersonal relationships, incentives, gifts, commissions, competing responsibilities, and undisclosed interests can affect negotiation judgment or create the appearance of compromised independence.
  • Know when to walk awayTrust building does not require accepting an agreement at any cost.

Build Trust & Agreements That Last

Full day only
  • Build credibility through consistencyTrust develops when words, evidence, behavior, and commitments remain reasonably consistent over time.
  • Create procedural fairnessPeople are more likely to accept difficult outcomes when they believe they were heard, relevant information was considered, the process was understandable, and the rules did not change opportunistically.
  • Make commitments implementableTrust can collapse quickly when negotiators make attractive commitments that delivery teams cannot realistically honor.
  • Repair trust when something goes wrongBroken commitments, misunderstood terms, inaccurate information, or poor behavior do not always end a professional relationship, but repair requires more than reassurance.
